1. Introduction

By using this website, you are entering into a legally binding agreement with FLY HOPER LTD, doing business as hoper, (“our Company,” “we,” “us,” or “our”). We are a private company, registered in Cyprus and our registered office is at Ifigeneias 17, Nicosia 2007, Strovolos, Cyprus. Our Services are comprised besides our website and in general any interactive feature or other software and any information provided or made available by us and our website, available at https://flyhoper.com/ (including any versions optimized for viewing on a wireless or tablet device).

2. Booking process

In order to use our website, https://flyhoper.com/ and therefore our Services, namely helicopter passenger transfer, you shall visit our website as a guest. You can book your helicopter flight tickets within the relevant platform of our website as a guest, without following any steps for your registration as a member. For the completion of your booking, you just choose the flights of your preference by defining the places of departure and arrival accordingly, the specific schedule as well as the fare (light or flex) for each specific flight and then proceed to the relevant booking form, where you should fill in the following information:

your full name
your birth date and your id number
your email address as well as your contact details

At this stage and in case you wish to receive any company updates, special offers and news, you can opt-in the relevant box. Then, before completing the process of your flight booking, you are able to add any extra services including extra baggage or even a transfer service after landing, each one at an additional cost. This step is optional. The completion of your booking shall be carried out by the acceptance of the Booking Terms and our Privacy Policy (by opting in the relevant box), as well as the final confirmation of your booking upon the completion of the payment process. After this step, you will receive a confirmation email from our website regarding the booking of your helicopter transfer to the email address that you have filled in within the aforementioned booking form.

3. Payment methods

For any service that you book within our website, you agree to pay the price set out (including any sales taxes and surcharges). By using any of the following payment methods, you also confirm and warrant that you are authorized to use the payment method [credit, debit or prepaid card, Google pay, Apple pay] you provide to us. For the security of your electronic transactions with our Company by using credit or debit cards, when you purchase any of our transfer services you agree and consent to third-party processing partners of our Company collecting and storing your payment method information through an internationally recognized and certified electronic transaction system.

By submitting that information to our third party (credit card) processors, you agree that you authorize them to charge your card at their convenience within one day of card authorization. Our Company does not collect or store any of your payment method information. By purchasing a specific transport service, you are also considered to have reviewed carefully and consent to each transfer requirements before completing the payment.

We reserve the right to refuse or cancel your booking at any time for certain reasons, including but not limited to service availability, errors in the description or price of the service, as well as if fraud or unauthorized or illegal transaction is suspected.

4. Personal Data

Any and all of your personal information, including but not limited to names, email addresses, addresses, your location will be collected and kept by our Company, in accordance with its Privacy Policy.

5. License of use

According to these Terms, as well as our Company’s Privacy Policy and any additional terms, our Company grants you a non-exclusive, non-assignable, non-transferable and revocable license to view, display and use our Company’s website and booking platform, including its content, services and features, on your mobile device or other device for your personal use only. This license does not include or provide any right of commercial use of the website. Except as expressly permitted herein, our Company’s website and the relevant booking platform and/or any portion of its Services may not be reproduced, sold, resold, visited or otherwise exploited for any other purpose without our Company’s express written consent.

6. Changes - Re-booking & Cancellation - No show

Our policies regarding changes - re-booking as well as cancellation - no show events are clearly provided within our Booking Terms and Conditions.

7. Suspension and termination

We may, from time to time, with or without prior notice, temporarily suspend the operation of any of our Services or features (in whole or in part), either for maintenance purposes or in order to update or upgrade any contents, features or functionality of our Company’s booking platform. We may also from time to time, with or without prior notice, at our sole and absolute discretion, make additions to, modifications to the format and features of our website or even terminate any of our Services.

8. Trademarks and Intellectual Property rights

All of the content featured or displayed on our website and all marks or elements of our Services, including without limitation to text, graphics, images and illustrations, source codes, software, designs, and all and any registered trademark and trade name of our Company used herein, are owned by our Company and are protected by copyright, trademark, moral rights and other laws relating to intellectual property rights. You may not copy, reproduce, republish, furnish, create derivatives of, transmit, display, post, upload, modify, distribute or in any other way use or exploit our Company’s trademarks or copyrights or other intellectual property rights, without our Company’s prior written consent. You shall not copy or remove any trademark, copyright or other proprietary notices from the website or our Services and features.

You expressly understand and acknowledge that our Company’s trade name, registered trademarks, copyrights and any intellectual property regarding the website and our Services shall all remain the exclusive property of our Company or its affiliates, subsidiaries, agents etc.

Our website may from time to time contain links that lead to other apps or websites, which are not owned, operated or controlled by our Company. These apps or websites are owned and controlled by third parties, and under no circumstances will our Company be liable for their content, privacy policies or practices, or for any financial or other type of loss or damage that you may sustain following those links. You understand and agree that following these links is subject to your personal and sole consent and that our Company does not control third parties’ services. Our Company shall not be responsible for any communication between you and third service Providers being advertised on the Platform or for any commercial transaction that may arise from this communication. We reserve the right to remove or add links without any warning to any party and to change the contents of the Platform on this matter at any time.

Our Company shall not be liable or responsible in negligence or otherwise to any third party for any information or advice expressly or impliedly given by our Company, or any act, omission or inaccuracy by the latter.

Nothing in these Terms will be construed to create any rights in favor of any third party other than our Company and you.

If you disagree with any changes in these Terms and you do no more wish to be subject to the revised Terms, you will need to deactivate your account by contacting our support team.

12. Applicable law

All the above-mentioned terms are considered as essential. Should any of these terms become against the law, it becomes inactive and is removed from this Agreement without affecting in any way the validity of the other terms.

This Agreement with any modification or alteration on them, as well as any additional terms are subject to the laws of the Cyprus.

If any dispute or difference arises out of or in connection with this Agreement or our Company’s website and its Services, it shall be resolved by the courts of Cyprus, which shall have exclusive jurisdiction.
